By using the Lendr platform, whether as a visitor or a user, you agree to comply with and be bound by these Terms of Service ("Terms"). When you list products and services for rent as an "Owner," you agree to comply with the Owners' Rules, and when you rent products and services from an Owner as a "Renter," you agree to comply with the Renters' Rules. These Terms of Service constitute a legally binding agreement between you and Worldwide Tech Inc., doing business as Lendr ("Lendr"), which provides access to the Lendr platform, including the website, any smart device applications, and all associated services.

1. Description of Lendr Services
1.1 Lendr is an online platform that allows registered customers ("Owners") to list products available for rent to other registered customers ("Renters").
1.2 Lendr acts only as an intermediary for transactions between Owners and Renters. When an Owner rents a product or service to a Renter, they enter into a direct contract with each other, not with Lendr.
1.3 Lendr cannot be held responsible for the conduct of users and, to the maximum extent permitted by law, excludes liability for such conduct.
1.4 Lendr will facilitate dispute resolution but cannot guarantee the truth, accuracy, safety, existence, or legality of any product or service listed for rent.
1.5 If an Owner or Renter fails to comply with the Terms of Service, Lendr reserves the right to remove listings and/or cancel transactions with written notice.
1.6 Owners must comply with the Owners' Rules and are responsible for any noncompliance.
1.7 Renters must comply with the Renters' Rules and are responsible for any noncompliance.
2. Use of the Lendr Platform and Eligibility
2.1 You must provide accurate and current information and update your profile as needed.
2.2 You must be at least 18 years old.
2.3 You may not register multiple accounts without permission.
2.4 You are responsible for securing your login credentials.
2.5 Abide by all posted rules and platform terms.
2.6 No posting of false, misleading, offensive, or illegal content.
2.7 No use of bots, scrapers, or automated methods.
2.8 You agree to indemnify Lendr against legal claims due to your misuse.
2.9 You’re granted a revocable, non-exclusive, non-transferable license to use Lendr.
2.10 You may deactivate your account in settings or by emailing support.
3. Modification of Terms of Service
We may change these Terms at any time. Updates will be posted and your continued use of Lendr means you agree to them.
4. Posted Content on the Lendr Service
4.1 You are responsible for any content you submit.
4.2 By posting content, you grant Lendr a worldwide, royalty-free license to use it.
4.3 You waive attribution rights for your content.
5. Right of Lendr to Remove from the Lendr Platform
5.1 We may remove content or suspend accounts for violations, fraud, or legal reasons.
5.2 Lendr reserves the right to cancel listings or restrict access at its discretion.
6. Fees and Commission
6.1 Owners pay a 5% commission.
6.2 Renters pay the rental fee + commission when a request is approved.
6.3 Users handle applicable taxes.
6.4 All fees are in USD and may change with notice.
6.5 Stripe and PayPal process payments; you agree to their terms.
7. Canceling Transactions or Listings
7.1 Renters may cancel pre-confirmation requests at no charge.
7.2 Renters canceling within 24 hours of rental start incur a 5% fee.
7.3 Owners may cancel pre-confirmation requests freely.
7.4 Owners must cancel at least 72 hours in advance to avoid a penalty.
7.5 Cancellations within 72 hours result in a 30% penalty to Owners.
8. Review and Ratings
8.1 Reviews must be honest, non-offensive, and accurate.
8.2 Do not post spam, private info, or advertising.
8.3 No manipulation of reviews or ratings allowed.
9. General Liability
9.1 Lendr is not liable for fraud, injury, or death caused by user conduct.
9.2 Renters assume full liability for items they rent.
9.3 Owners must accurately describe listings.
9.4 Late returns may be charged.
9.5 Unpaid amounts may be sent to collections.
10. Lendr Guarantee
10.1 Every item approved for listing on Lendr is automatically covered by Lendr’s Guarantee for up to $5,000 against damages, loss, or theft while in the possession of a renter. This coverage is provided directly by Lendr and does not require businesses or owners to file claims with external insurance providers.
10.2 In the event of an approved claim, Lendr will pay the Owner directly, without requiring the Owner to interact with any third-party insurance companies. Claims are handled internally at Lendr’s discretion based on verification of incident details.
10.3 The Lendr Guarantee coverage activates automatically once a listing is approved on the platform, regardless of the nature of the product. All approved listings are eligible unless explicitly excluded under the Prohibited Items Policy.
10.4 Owners are not required to carry private insurance to qualify for the Lendr Guarantee. However, personal insurance may still be advisable for additional coverage beyond the $5,000 limit.
10.5 Insurance Disclaimer:
The Lendr Guarantee is a goodwill protection program offered at the sole discretion of Worldwide Tech Inc., doing business as Lendr. It is not an insurance policy and Lendr is not an insurer. Users seeking additional or different coverage are responsible for arranging their own insurance if desired. The Lendr Guarantee does not replace or serve as primary or secondary insurance.
11. Personal Information and Privacy
11.1 By using Lendr, you agree to our Privacy Policy.
11.2 You consent to receive marketing unless you opt out.
11.3 We may verify your identity or conduct compliance checks.
12. Third-Party Rights
No third-party may enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
13. Disputes (Expanded)
13.1 You release Lendr from claims arising from other users.
13.2 Lendr may help resolve disputes but is not liable.
13.3 Disputes must be resolved via binding arbitration, not in court.
13.4 Arbitration will take place in Michigan, governed by its laws.
13.5 You waive your right to a jury trial or class action participation.
13.6 Lendr may seek injunctive relief to protect its platform or IP.
14. General
14.1 Lendr may act at any time on violations.
14.2 We may transfer rights to others without your consent.
14.3 Your use is subject to applicable laws.
14.4 No employment or agency relationship is created.
15. Renter Rules
Renters must use the platform respectfully, comply with rules, and communicate only through Lendr.
16. Owner Rules
Owners must ensure their items are eligible for listing and handle all communications through Lendr.
17. Promos and Credits
17.1 Lendr may issue credits toward rentals.
17.2 Credits may be removed or expire at Lendr’s discretion.
18. Get $5 Give $5
18.1 Share a unique referral code to earn credit.
18.2 Abuse (e.g., spam or fake signups) will void credits and accounts.
19. No Warranty
19.1 Lendr is provided "as is" with no warranty.
19.2 We are not responsible for third-party services or damages.
20. Biometric Authentication
20.1 Face ID, Touch ID, and similar biometric tools are supported.
20.2 Biometric data is never stored by Lendr—it's handled by device manufacturers.
20.3 Use is governed by the device manufacturer’s policies.
20.4 Lendr disclaims any liability related to biometric data security.
20.5 Alternate login methods are available if biometrics are not used.
21. Prohibited Items Policy
21.1 The following are banned from Lendr:
- Firearms, explosives, or ammunition
- Illegal drugs or drug paraphernalia
- Alcohol or tobacco
- Adult content or services
- Stolen or counterfeit items
- Recalled or prescription-required equipment
- Hazardous or banned materials
- Human/animal body parts
- Any illegal item or service
21.2 Listings violating this policy will be removed, and accounts may be suspended.
22. Community Guidelines and Moderation
22.1 Treat others with respect; harassment or hate speech is prohibited.
22.2 No spam, scams, or misleading content.
22.3 Listings must be honest and clear.
22.4 Communication must remain professional.
22.5 Lendr may moderate, remove, or suspend any violators.
23. Business Partner Terms
23.1 Businesses in Lendr promotional programs must comply with these Terms.
23.2 Business listings must stay active through the agreed campaign period.
23.3 Lendr may use brand materials for marketing unless declined in writing.
23.4 Pricing and availability must be honored.
23.5 Any incentives offered are subject to fraud review and verification.
